Please read these Terms and Conditions ("Terms") carefully before using the services offered by THERARE-GLOBALCONSULTING ("THERARE-PRIVATE", “we", "us" or "our").
By accessing our website at www.therare-private.com (the "Site") and submitting your information via our forms or by email, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site or submit any information to us.


1. Definitions


  • "Brand" refers to a company, organization, or individual seeking to engage influencers for marketing campaigns.
  • "Influencer" refers to a content creator, public figure, or private individual seeking collaboration opportunities with Brands.
  • "You" / "Your" refers to any user of the Site, whether a Brand or an Influencer.
  • "Submission" refers to any data, information, content, or materials you provide to us through our online forms, via email, or by any other means.
  • "Database" refers to our internal system (including but not limited to Excel spreadsheets, CRM software, or other data management tools) where we store and process Submissions.


2. Our Service


THERARE-GLOBALCONSULTING operates as an influencer marketing agency. Our primary service, as facilitated through this Site, is to collect information from Brands and Influencers to build a proprietary database. We use this database to identify, match, and present potential collaboration opportunities between Brands and Influencers.


Please note:  Submitting your information does not guarantee that you will be matched, selected for a campaign, or contacted by us or any third party. We are not a party to any final agreement between a Brand and an Influencer.


3. User Submissions and Licenses


3.1. Accuracy of Information:  You represent and warrant that all information you submit to us is accurate, truthful, and complete. You agree to update your information promptly if any changes occur.


3.2. License to Use Your Submission: By submitting your information, you grant THERARE-GLOBALCONSULTING a worldwide, non-exclusive, royalty-free, sublicensable license to:


* Store, reproduce, and process your Submission in our Database.


* Use, analyze, and evaluate your Submission for the purpose of potential matching.


* Present, display, and share your Submission (including profile information, statistics, and content examples) with potential Brand or Influencer partners, strictly for the purpose of facilitating a potential marketing collaboration.


3.3. Influencer Content:  If you are an Influencer and submit examples of your content (e.g., social media handles, links to posts, videos, images), you confirm you own or have the necessary rights to such content and that granting us the license in Section 3.2 does not violate any third-party rights.


4. Data Storage and Privacy


We will store your Submission in our Database for as long as we deem necessary for our business purposes, including for future matching opportunities. You can request the removal of your data by contacting us at support@therare-private.com. For detailed information on how we collect, use, and protect your personal data, please refer to our separate Privacy Policy.


5. User Responsibilities and Warranties


You agree not to submit any information that is:


  • False, misleading, or fraudulent.
  • Defamatory, obscene, harassing, or otherwise unlawful.
  • In violation of any intellectual property rights of a third party.
  • Contains viruses or any other malicious code.


6. Disclaimer of Warranties


OUR SITE AND SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SUCCESS OF ANY MATCHING, THE AVAILABILITY OF OPPORTUNITIES, OR THE ACCURACY OF INFORMATION PROVIDED BY OTHER USERS. WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE ACCESS TO OUR SERVICES.


7. Limitation of Liability


TO THE FULLEST EXTENT PERMITTED BY LAW, [YOUR COMPANY NAME] AND ITS DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, YOUR INABILITY TO BE MATCHED, OR ANY COMMUNICATIONS OR DEALINGS WITH ANY THIRD PARTY (E.G., A BRAND OR INFLUENCER) YOU CONNECT WITH THROUGH OUR SERVICES.


8. Indemnification


You agree to indemnify and hold harmless THERARE-GLOBALCONSULTING from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your breach of these Terms, your Submission, or your violation of any law or third-party rights.


9. Changes to Terms


We reserve the right to modify or replace these Terms at any time at our sole discretion. The "Last Updated" date at the top will indicate the latest revision. By continuing to use our Site after any changes, you agree to be bound by the revised Terms.


10. Governing Law


These Terms shall be governed by and construed in accordance with the laws of United Arab Emirates, without regard to its conflict of law provisions.
